These Terms are issued by Rally (ABN 80 987 296 446) ("Rally", "we", "our", or "us").
1. Eligibility
You must be of legal drinking age in your country or region to use Rally. By using the App, you confirm that you meet this requirement. You must also be at least 18 years old. If the legal drinking age where you are located is higher than 18, you must meet that higher age requirement.
Rally is not intended for children or for anyone who is not legally allowed to consume alcohol in the location where they use the App.
2. User Accounts
To access certain features, you must create an account. You agree to:
- Provide accurate and complete information
- Keep your login details secure
- Be responsible for all activity under your account
- Keep your age, location, profile, and venue/business account information accurate and up to date.
- Notify us at support@rallyaus.com if you believe your account has been accessed without permission.
We reserve the right to suspend or terminate accounts that violate these Terms.
Venue or business accounts must only be created by people authorised to act for the relevant venue or business.
3. Acceptable Use
You agree NOT to:
- Use the App for illegal purposes
- Harass, abuse, or harm other users
- Post false, misleading, or offensive content
- Upload content that violates the rights of others
- Encourage excessive or irresponsible alcohol consumption
- Misrepresent your age, identity, authority to act for a venue, location, relationship to another user, or right to upload or share content.
- Use Rally to organise, promote, or facilitate unlawful alcohol supply, underage drinking, drink driving, violence, stalking, harassment, exploitation, or unsafe behaviour.
- Scrape, copy, harvest, reverse engineer, bypass security, interfere with the App, use bots, or access data you are not authorised to access.
- Post another person's private information without permission, including exact location, contact details, photos, or sensitive personal information.
We may remove content or restrict accounts that violate these rules.
4. User Content
You retain ownership of content you upload, such as photos, check-ins, and posts.
By posting content, you grant Rally a worldwide, non-exclusive, royalty-free license to:
- Use, display, and distribute your content within the App
- Promote and improve the service
- Host, store, reproduce, resize, format, adapt for technical display, communicate, and make your content available to users and service providers as needed to operate, secure, moderate, improve, and support Rally.
- Use check-in and social activity to create aggregated, de-identified, or statistical venue insights and product analytics.
You are responsible for the content you share. You represent that you have the rights and permissions needed to share it, including permissions from people shown or identified in photos, tags, comments, or check-ins where required.
5. Social Features and Visibility
Your activity, such as check-ins and social interactions, may be visible to other users depending on your privacy settings and app functionality.

Rally includes check-ins, home check-ins, tags, joinable tables, join requests, delayed visibility, another-round updates, comments, likes, cheers, connection requests, close friends, invite codes, QR connection flows, profile visibility controls, and notification features.
Privacy and visibility settings affect how information appears inside Rally, but they do not guarantee secrecy. Other users may see, copy, screenshot, remember, or share information that is visible to them. Do not share a check-in, photo, comment, or tag if you are not comfortable with the relevant audience seeing it.
Rally does not verify that a user is actually at a venue, that a venue is safe, that another user is trustworthy, or that a check-in means a user is available to meet. Use common sense and contact emergency services if there is an emergency.
6. Data and Venue Insights
Rally may use user activity data to generate insights and analytics for venue partners. Venue insights may include aggregated counts and trends such as check-ins, unique visitors, drink-type breakdowns, popular times, daily/hourly trends, and average party-size estimates. Venue partners must not attempt to identify individual users from aggregated insights or use Rally data for unlawful, discriminatory, or unsafe purposes.

8. Third-Party Services
The App may include integrations with third-party services. We are not responsible for the practices or content of those services. These may include hosting, database, object storage, authentication, email, push notification, map/venue lookup, browser, mobile platform, and other infrastructure or support providers, as well as venue or third-party websites you access outside Rally.
Map and venue features may rely on third-party providers such as Geoapify, OpenStreetMap, OpenMapTiles, or Overpass. Provider availability, accuracy, usage limits, attribution requirements, and provider terms may apply to those features.
9. Paid or Business Features
If Rally introduces paid subscriptions, paid venue features, advertising products, or other commercial services, additional pricing, payment, renewal, cancellation, tax, refund, and provider terms may apply and should be presented before purchase.
10. Disclaimers
Rally is provided "as is" to the fullest extent permitted by law, except for any rights, guarantees, warranties, or remedies that cannot lawfully be excluded, restricted, or modified.
Rally is a social and venue-discovery tool. It is not alcohol, health, safety, transport, emergency, legal, or venue-verification advice. We do not guarantee the accuracy of venue data, map data, user content, availability of users, venue conditions, or user conduct.
11. Limitation of Liability
To the fullest extent permitted by law, Rally and its operators are not liable for:
- Indirect or consequential damages
- Loss of data or profits
- Personal injury, property damage, loss, or harm arising from user conduct, venues, alcohol consumption, travel decisions, reliance on check-ins, or interactions arranged through the App, except to the extent liability cannot lawfully be excluded or limited.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, liability, or remedy that applicable law says cannot be excluded, restricted, or modified.
12. Account Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Misuse the platform
- Pose a risk to other users or the service
- Are under the required age, provide false information, attempt to bypass safety or moderation controls, or use Rally in a way that may expose Rally, users, venues, or the public to legal, safety, security, or reputational risk.
You may delete your account at any time. Account deletion is designed to anonymise account/profile information, delete or reset saved settings, push tokens and push subscriptions, related session records, private notifications, and connection/close-friend relationships, and end active check-ins. Historical check-ins and some related content, reports, audit logs, aggregated analytics, backups, safety/legal records, or operational records may remain as described in the Privacy Policy.
Rally reserves the right to remove content or suspend accounts at its discretion where necessary to protect users, comply with applicable laws, or maintain platform integrity.
13. Reports, Moderation, and Enforcement
Users may report content, check-ins, or users. Rally may review reports, add moderation notes, keep audit logs, restrict features, suspend accounts, remove content, anonymise accounts, or cooperate with legal authorities where appropriate. We are not required to disclose all moderation reasons, internal notes, or security details where doing so would create risk or violate another person's rights.
14. Changes to Terms
We may update these Terms periodically. Continued use of the App after changes means you accept the updated Terms. If changes are material, we may provide additional notice as required by law.
15. Governing Law
These Terms are governed by the laws of South Australia, Australia, except where mandatory consumer protection laws require otherwise.

All content, features, and functionality of the Rally app, excluding user-generated content, are owned by Rally and are protected by applicable copyright and intellectual property laws. You may not copy, modify, distribute, sell, lease, or reverse engineer any part of Rally except as allowed by law or with our written permission.

If you believe that any content on Rally infringes your copyright, please contact us with details of the alleged infringement. Send copyright complaints to support@rallyaus.com and include enough information for us to identify the content, your contact details, the rights you claim, and the action you request.
